Man Sentenced to 15 Months in Prison for Threatening Congresswoman

In response to the Indictment in U.S. v. Comiskey, the defendant Tweeted, about Rep. Lauren Boebert,

• “If I ever noticed Lauren I would be glad to take her out and go to jail. Could be job properly completed.”
• “Don’t fret Lauren, somebody is coming quickly to point out your face the 2nd modification in observe with a copper jacket. Take pleasure in.”
• “Somebody must put Lauren down like a sick canine. She is a real waste of life! Somebody train their 2nd modification proper to her face! Because the @CIA is a failure and @FBI is incompetent at charging her for being a terrorist it is time to do it ourselves! Pew pew Lauren.”
• “I bought my 2 modification software all able to destroy Lauren’s face! Hopefully in  entrance of her children.”
• “[D]on’t come to Florida us libs have huge weapons right here and we stand out [sic] floor. Take you down like Trayvon.”

Defendant pleaded responsible (and was sentenced Monday), so we do not have extra detailed info concerning the context right here. However on its face, these do certainly look like constitutionally unprotected “true threats” of legal conduct. And the court docket agreed that the indictment sufficiently alleged true threats, regardless of defendant’s argument “that two of the Twitter posts include conditional statements, whereas one other doesn’t point out that Defendant ‘personally’ threatened to shoot the Consultant.”
